Terms of Service

Welcome to SafetyOrbit. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

By accessing and using the Services, you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using these particular Services, you shall be subject to any posted guidelines or rules applicable to such Services. Any participation in this Service constitutes acceptance of this agreement. If you do not agree to abide by the above, please do not use these Services.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our Services. By using the Services, you represent and warrant that you meet these eligibility requirements and that you have the legal capacity to enter into a binding agreement.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services in any way that violates any applicable local, national, or international law or regulation; to transmit any advertising or promotional material without our prior written consent; to impersonate or attempt to impersonate the company, an employee, another user, or any other person or entity; or to engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services.

5. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SafetyOrbit, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. User Content

Our Services may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post to the Services, including its legality, reliability, and appropriateness. By posting content to the Services, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Services.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activities include, but are not limited to, systematically retrieving data to create a collection or database; making any unauthorized use of the Services; engaging in unauthorized framing of or linking to the Services; uploading or transmitting viruses, Trojan horses, or other malicious code; and attempting to bypass any measures designed to prevent or restrict access to the Services.

8. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Services.

9. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Your use of the Services is at your sole risk. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Limitation of Liability

In no event shall SafetyOrbit, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

10a. Governing law

These Terms are governed by the law of the country in which you are resident, and you may bring proceedings in the courts of that country. Nothing in these Terms removes any right you have under the mandatory consumer-protection law of your own country. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Paid plans

Alongside the free account, SafetyOrbit offers paid access. Prices and what each plan includes are set out on the pricing page and, for companies, on the employer plans page. At the time of writing these are an Individual plan at €89 for twelve months, and Employer plans at €290, €690 and €1,290 per year according to the number of people covered.

Term and renewal. Paid access runs for twelve months from the date access is granted. It does not renew automatically and no payment is taken automatically. If you want a further year you buy it again.

VAT. SafetyOrbit is not VAT registered. No VAT is charged on these prices and none is recoverable.

Payment. Plans are arranged by enquiry and paid against an invoice by bank transfer. Access is granted once payment is received. No card details are collected or stored by this site.

Refunds. If the material does not suit how you work, tell us within 30 days of purchase and we refund it in full. For employer plans this applies to the whole plan rather than to individual seats. This is offered in addition to any statutory right of withdrawal you may have.

Seats. An employer plan covers the stated number of people within one organisation. Accounts are for named individuals and may not be shared between people or passed to another company. Seats may be added during the year at the difference in price.

What paid access is not. SafetyOrbit is not an accredited training provider and does not deliver statutory training. A completion certificate issued by this site records that a person worked through the material and passed an assessment. It is supplementary and does not discharge any duty imposed on you by the law of your country. Full detail is on the licence page.

Availability. We may change, add or withdraw material as standards are revised. Where a change materially reduces what a current paid plan provides, we will offer a pro-rata refund for the unexpired part of the term.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
